Pet owners face five years in prison and $2,500 fines if they break new ‘family’ law which goes into effect THIS WEEK
A landmark amendment to the family protection act now categorizes pets as full family members under the law. Starting this week, any form of neglect, abandonment, or cruel tethering in extreme weather can trigger felony charges — with penalties up to five years imprisonment and fines reaching $2,500 per violation.
The new statute, which amends Title 4 of the Family Code, was quietly signed last month but takes effect this week across all jurisdictions. It elevates the legal status of companion animals, allowing courts to treat them similarly to dependent children in cases of endangerment. Authorities have already announced a "zero tolerance" week of education and enforcement.
"This is not just a fine — it's a fundamental shift in how we value the lives of pets," said an ASPCA spokesperson. Shelters and rescue groups have been scrambling to inform the public, especially in rural areas where outdoor dogs are common. The law also mandates that during natural disasters, evacuation plans must include pets, and failure to do so could lead to charges.
Prosecutors in three states have already stated they will pursue maximum sentences for egregious cases. "If you leave a dog chained outside in a blizzard, you will face the full extent of this law," said a district attorney in upstate New York. Meanwhile, some farm bureaus have raised concerns about working dogs, but the legislation includes exemptions for veterinary care and temporary restraint.
The bill passed with bipartisan support after several high-profile cases of animal neglect were caught on video last winter. President signed it into law in December, but the delayed effective date gave owners a 60-day grace period — which ends this Thursday.
